1. Purpose and Scope of this Agreement

This Liability Agreement establishes the conditions under which the user assumes full responsibility for engaging in physical activities recorded or monitored through the Spevo Sport & Health Club application (“Spevo”), acknowledging that the use of the platform involves risks inherent to sports activities and that Spevo does not replace medical, nutritional, physiotherapeutic, or equivalent professional guidance. By using the application, the user declares awareness that all information provided is purely informational and educational in nature and must not be interpreted as clinical recommendations, diagnoses, or therapeutic prescriptions.

2. User’s Statement of Health Conditions

By accepting this Agreement, the user declares, under their sole responsibility, that they are in physical and psychological condition suitable for engaging in physical and sports activities, and that they have undergone and will continue to undergo appropriate medical follow-up to verify their fitness for sports practice. The user acknowledges that it is exclusively their responsibility to assess their own health condition, physical limits, medical restrictions, and any warning signs, agreeing to immediately discontinue any exercise in case of pain, discomfort, malaise, or any indication of risk.

3. Risks of Physical Activity and Individual Responsibility

The user acknowledges that all exercise or physical activity involves inherent risks, including but not limited to muscle injuries, fractures, cardiac issues, worsening of pre-existing conditions, accidents, falls, incidents in public areas, weather-related impacts, equipment failures, and risk of death. The user voluntarily and fully assumes such risks when using Spevo, agreeing to adopt appropriate safety measures, including proper hydration, use of adequate equipment, warm-up exercises, knowledge of personal limitations, and awareness of environmental conditions during the activity.

4. No Medical or Health Professional Relationship

Spevo does not provide and does not replace any type of consultation, diagnosis, treatment, professional evaluation, or health monitoring. No content, analysis, artificial intelligence output, recommendation, estimate, or metric presented by Spevo should be considered medical, nutritional, psychological, or physiotherapeutic advice. The user agrees to seek qualified professionals whenever necessary and acknowledges that decisions regarding their health must never be made solely based on information provided by the application.

5. Proper Use and User Responsibility

The user is fully responsible for the manner in which they use the platform and for any consequences arising from that use, agreeing to use Spevo safely, legally, ethically, and in alignment with their physical capabilities. The user acknowledges that the application may present technical limitations, variations in accuracy, temporary failures, or inconsistencies in generated data, especially when associated with external sensors such as smartwatches, heart-rate monitors, and third-party devices, and that Spevo bears no responsibility for misinterpretation or misuse of such information.

6. Spevo Liability Disclaimer

Spevo, its administrators, representatives, licensors, and partners shall not be held liable for any direct or indirect damages, material or immaterial, moral or financial, arising from the practice of physical activities or from the use of the application, including but not limited to accidents, injuries, technical failures, incorrect data interpretation, improper use of equipment, external device errors, or decisions made by the user based on information provided by Spevo. The use of the platform is entirely at the user’s own risk.

7. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. The parties agree that the courts of Hong Kong shall have exclusive jurisdiction to resolve any disputes arising out of or in connection with this Agreement, waiving any other jurisdiction, however privileged it may be.
